Agreement to Terms

By accessing or using the YNM (Yes, No, Maybe) mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

YNM is a relationship communication tool that helps couples explore shared interests and activities through a card-based interface. Users can:

• Swipe Yes/No/Maybe on relationship activity cards
• Link with a partner to compare responses
• Upgrade to Premium to see matches and compatibility insights

Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

Account Registration

Anonymous Accounts

• The App creates an anonymous account using Firebase Authentication
• You are responsible for maintaining the security of your device and account, including the risk of account loss if the app is deleted or the device is reset

Linking with a Partner

• You may link your account with one partner at a time
• Both partners must consent to linking
• Either partner may unlink at any time
• Unlinking removes shared match data but preserves individual responses

Premium Subscription

Subscription Terms

• Premium subscription pricing is displayed in the App and may vary by region
• Payment is charged to your App Store (iOS) or Google Play (Android) account
• When one partner subscribes, both partners in a linked couple get Premium access
• Subscription automatically renews unless cancelled at least 24 hours before renewal

Premium Features Include:

• Full list of all matches (perfect matches and maybe matches where neither said NO)
• Compatibility insights and category breakdowns
• Discussion starters (areas of disagreement)

Subscription Clarifications

• When one partner subscribes, both partners in an active linked couple get Premium access
• If the link is broken, only the paying subscriber retains Premium access
• If you link with a new partner, one partner must have an active subscription for both to access Premium features
• First-time subscribers may be offered promotional pricing
• Pricing may vary by region due to currency exchange and local taxes
• Price changes will be notified before your next renewal period

Cancellation and Refunds

• You can cancel your subscription anytime through your App Store or Google Play account
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods
• Refund policy follows App Store and Google Play guidelines

UK and EU Consumer Rights

• UK and EU consumers have a 14-day right to cancel under consumer protection laws
• By starting your subscription and accessing Premium features immediately, you agree to waive this right for content already accessed
• If you cancel within 14 days before accessing any Premium features, contact support@ynm.me for a refund
• Refunds for other periods follow App Store and Google Play policies
• Nothing in these Terms affects your statutory rights under UK or EU consumer protection laws

User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots) to interact with the App
• Share inappropriate or offensive content (via custom cards, when available)

Content Moderation

• We reserve the right to review and remove content that violates these Terms
• We may use automated systems and manual review for content moderation
• Repeated violations may result in account suspension or termination without refund
• Appeals can be submitted to support@ynm.me

Intellectual Property

Our Content

• The App, including all content, features, and functionality, is owned by Code Tone Studio
• Card content, UI design, and branding are protected by copyright and trademark laws
• You may not copy, modify, distribute, or create derivative works without permission

User Content

• You retain ownership of your responses and any custom content you create
• By using the App, you grant us a license to store and process your content to provide the service
• We may use anonymized, aggregated data for analytics and improvement

Data and Privacy

Your use of the App is subject to our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

Account Deletion

You may delete your account at any time via Settings > Delete Account. This will:

• Permanently delete all your responses, links, and profile data
• Cannot be undone
• Does not provide a refund for remaining subscription time

Termination

We reserve the right to:

• Suspend or terminate your account for violations of these Terms
• Discontinue the App or any features at any time with reasonable notice
• Terminate accounts that have been inactive for extended periods, where permitted by law

Upon termination, your right to use the App immediately ceases. All provisions that should reasonably survive termination will continue to apply, including Intellectual Property, Limitation of Liability, and Indemnification sections.

Disclaimers

No Relationship Advice

• YNM is a communication tool, not professional relationship counseling or therapy
• We do not guarantee any specific outcomes in your relationship
• For serious relationship issues, consult a licensed professional

"As Is" Service

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do not guarantee the App will be error-free, secure, or uninterrupted
• You use the App at your own risk

Limitation of Liability

What We Don't Limit

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Breach of terms implied by law that cannot be excluded or limited
• Any other liability that cannot be excluded under UK or applicable law

Liability Limits

Subject to the above, to the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid for the subscription in the past 12 months (or £75, whichever is greater)
• This includes damages from loss of data, profits, use, or relationship issues
• We are not liable for any loss resulting from causes beyond our reasonable control

Indemnification

Business Users

If you are using the App for business purposes, you agree to indemnify and hold harmless Code Tone Studio from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Consumer Users

If you are using the App for personal, non-commercial purposes, you are only responsible for losses directly caused by your intentional or negligent breach of these Terms or violation of third-party rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Any disputes will be resolved in the courts of England and Wales.

EU Consumers: If you are a consumer in the European Union, you also have the right to bring proceedings in your local courts, and nothing in these Terms affects your statutory rights under local consumer protection laws.

Dispute Resolution

Informal Resolution

We encourage you to contact us first at support@ynm.me to resolve any disputes informally. Most concerns can be resolved quickly through direct communication.

EU Online Dispute Resolution

If you are an EU consumer, you may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/

App Store Disputes

For subscription billing disputes, contact your app store provider (Apple or Google) directly, as they process all payments.

Changes to Terms

We may update these Terms from time to time. We will notify you by:

• Updating the "Last Updated" date at the top of this page
• In-app notification for material changes
• Push notification for significant changes that affect your rights

For material adverse changes, we will provide 30 days notice before the changes take effect.

Continued use of the App after the notice period constitutes acceptance of the updated Terms. If you do not accept the changes, you may cancel your subscription and delete your account before the changes take effect.

Third-Party Platforms

App Store and Google Play

• All subscriptions are managed through your App Store (iOS) or Google Play (Android) account
• Refund policies are subject to Apple and Google's respective terms and policies
• For subscription billing issues, contact your app store provider directly
• Apple Inc. and Google LLC are not parties to these Terms and have no obligation regarding the App
• Code Tone Studio, not Apple or Google, is solely responsible for the App and its content

Third-Party Services

The App uses third-party services (Firebase, Cloudflare, RevenueCat) as described in our Privacy Policy. Your use of these services through the App is subject to their respective terms and policies.

Export Control and Sanctions

You agree to comply with all applicable export control and trade sanctions laws and regulations, including those of the United Kingdom, European Union, and United States.

You may not use the App if you are located in a country subject to embargo or if you are on any restricted party list.

Force Majeure

We are not liable for any delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, riots, labor disputes, government actions, internet service disruptions, cyberattacks, or failures of third-party services.

Assignment

You may not transfer, assign, or delegate your account, these Terms, or any rights or obligations under these Terms without our prior written consent.

We may assign these Terms or any rights under these Terms to any affiliate, subsidiary, or successor without your consent. We will notify you of any such assignment.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Code Tone Studio.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Code Tone Studio regarding the App.

Survival

The following sections survive termination or expiration of these Terms: Intellectual Property, User Content licenses, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, Dispute Resolution, and any other provisions that by their nature should reasonably survive.
